KATHMANDU, May 9: Chief minister (CM) of Koshi Province, Kedar Karki, who has automatically rendered into a caretaker status after Province Chief Parshu Ram Khapunhg called for the formation of a new government, has decided to challenge the decision of Province Chief to relieve him from the post.

Sources said Chief Minister Karki has already arrived in Kathmandu to file a writ petition against the decision of Province Chief Khapung to relieve him from the post, summoning the parties to stake claim for the formation of new government.

Province Chief Khapung on Wednesday called for the formation of a new government as per Article 168 of the Constitution of Nepal.

Chief Minister Karki has claimed that the summon issued by the province chief to form a new government was a grossly unconstitutional step and that no provisions allows him to remove the chief minister from the post under the current circumstances. “Is it possible to form two parallel governments?” he asked.

Stating that he has taken a vote of confidence according to the constitution, Karki said that he will file a writ petition on Thursday against the call of the provincial head. The writ petition will demand the cancellation of the call by the provincial head and the continuation of the government under his leadership arguing that his government was formed as per Clause 5 of Article 168 of the constitution.
