NHRC, OHCHR, embassies urge action on disappearances

KATHMANDU, Aug 29: On the occasion of the International Day of the Disappeared (August 30), the National Human Rights Commission (NHRC) has urged the parties to the conflict to make public the whereabouts of those disappeared during the decade-long insurgency.



It has also urged the government to take action against human rights violators in order to provide social justice to the victims and also provide compensation, reparation and relief to those who were forcefully disappeared. [break]



Issuing a statement on Sunday, NHRC said that it received 3,397 complaints following the peace agreement, out of which the whereabouts of 815 people (614 from the state side and 201 from the Maoist side) is yet unknown.



Likewise, of the 93 cases of disappearance by unknown groups registered at the commission, the status of 46 people still remains unknown.



The statement signed by Chairman of NHRC Kedarnath Upadhyay said social justice has been denied to the families of the victims even when the two sides committed to make public the details of those missing within 60 days during the signing of the Comprehensive Peace Agreement.



Meanwhile, the Office of the UN High Commissioner for Human Rights in Nepal (OHCHR-Nepal) has urged the government to swiftly implement the landmark Supreme Court decision of June 1, 2007.



The SC had then ordered the government to enact a law which would criminalize enforced disappearances in line with the International Convention for the Protection of all Persons from Enforced Disappearance; establish a high level commission of inquiry on disappearances in compliance with the international criteria on such commissions of inquiry; launch investigations and prosecute persons responsible for disappearances; and provide for adequate compensation and relief to the victims and their families.



A statement issued by OHCHR-Nepal said that clarifying the fate of the victims of enforced disappearances and other human rights and humanitarian law violations lie at the heart of the peace process.



Likewise, the embassies of Australia, Canada, Denmark, European Union, Finland, France, Germany, Japan, Norway, Republic of Korea, Switzerland, the UK and the US have called on the government to demonstrate its commitment to accountability by ensuring full application of the rule of law to state and non-state personnel involved in disappearances.



They have also urged the Nepal Army and the UCPN (Maoist) to cooperate fully on the cases of disappearances.
