As per the interim constitution, the President is the Supreme commander of the Nepal Army. The constitutional provision stipulates that the President is authorized to approve upon recommendation of the Council of Ministers for control, deployment and management of the Nepal Army under existing legal framework.
Article 145 of the Interim Constitution 2007 grants authority to the National Security Council to make recommendation for NA's mobilization to the Council of Ministers. The National Security Council is chaired by the Prime Minister with Defense and Home Ministers as its members and three additional ministers from the cabinet representing different political parties who are selected by the PM, as stipulated in the Interim Constitution.
As per the constitutional provision the mobilization of the national army except in the event of a natural disaster has to be approved by a special committee designated by the parliament within a month after the government orders the deployment.
The Security Council meeting which sat on Monday morning recommended to the Council of Ministers to seek presidential approval for the army mobilization along with details relating to the search, rescue and relief efforts and the rehabilitation task underway in the aftermath of the massive earthquake.
