Constitutional Council fails to pick new chief justice

KATHMANDU, Dec 3 : The Constitutional Council (CC) on Monday failed to decide on a new chief justice seeking more time to study on the recommendations made by the Judicial Council.

KATHMANDU, Dec 3 : The Constitutional Council (CC) on Monday failed to decide on a new chief justice seeking more time to study on the recommendations made by the Judicial Council.


A meeting of the CC held at the Prime Minister’s Office, Singhadurbar failed to pick the new chief justice.

The next CC meeting will take place on December 8, according to National Assembly Chairman Ganesh Timalsina who is also a member of the Constiutional Council.


The CC should pick the successor of incumbent Chief Justice Om Prakash Mishra who is retiring on December 31 on the grounds of age, which is 65 years.


The council, which is headed by the prime minister, has Chief Justice Mishra, Speaker Krishna Bahadur Mahara, main opposition leader Sher Bahadur Deuba, upper house chairman Ganesh Timalsina, deputy speaker Shivamaya Tumbahamphe and law minister Bhanubhakta Dhakal as ex-officio members.


The Judicial Council secretariat had last week recommended seniormost justice Deepak Raj Joshee and justice Cholendra SJB Rana for appointment as the next chief justice. The secretariat made the recommendation as the council could not meet due to the differences between seniormost justice Joshee and law minister Dhakal.
