SRC members divided over five key issues

KATHMANDU, Feb 1: The majority and minority members of the State Restructuring Commission (SRC) are divided over five major issues though they have conflicting views on other issues also. This has led them to have different reports on federal model of Nepal.



According to members from the both the groups, who spoke to Republica on condition of anonymity Tuesday, they have major differences over the number of the states, right to self-determination, residual power, constitutional court and political preferential rights. [break]



First, the majority members led by SRC coordinator Madan Pariyar have recommended 11 states on the basis of viability and identity. But the minority three members have proposed six states on the same basis and most of these stretch from north to south.



 Second, the majority members have proposed right to self-determination without right to secession to the states but the minority members have opposed the idea.



Another issue of contention between the two groups is related to residual powers. The majority members have suggested in the report that all the residual powers, except those that affect the whole nation, should be given to states. But the minority group maintains that the residual rights should rest with the center.



Fourth, the SRC members also differ over whether there should be a separate constitutional court to take up controversies between the center and the states. The majority members have argued in the report that a regular court should be given the authority to settle disputes between the center and the states. But the minority members have argued for a separate constitutional court for such controversies.



Last but the not the least, the two camps differ over political preferential rights. The majority members have stated in the report that political preferential rights should be given to autonomous regions -- densely populated by a particular minority community -- within a state for one term only. But the minority members have opposed giving any political preferential rights.
