SC issues show case notice on judge appointments

KATHMANDU, July 18: The Supreme Court (SC) has issued a show cause order in the name of the defendants in response to a writ petition filed demanding removal of hurdles for the appointment of the judges. The writ has also been given special priority.



A single bench of Justice Ram Kumar Prasad Saha issued the order and also referred it to a full bench for hearing, as the demand of the petitioner was an issue of public interest and national concern.[break]



The writ was filed by Advocate Rajesh Silwal on July 14 demanding the removal of hurdles for the appointment of judges, arguing that it would violate citizen´s rights to justice and fundamental rights if judges were not appointed to the vacant posts. It may be noted that the appointment of judges has been stalled in the absence of a parliament that requires to conduct a hearing for it.



The Office of Prime Minister and Council of Ministers, Ministries of Law, Justice, Constituent Assembly and Federal Affairs, Parliamentary Secretariat and Judicial Council have been named defendants in the writ petition.
