KATHMANDU, Dec 24: The president´s office has said that the issue of selecting the prime minister does not fall under the jurisdiction of the judiciary as per the principle of separation of powers.

Responding to the Supreme Court (SC) in writing on Sunday, the president´s office has defended its decision to not pick Kishori Mahato for prime ministerial candidate.[break]

After conducting preliminary hearing on the petition filed by Mahato, a single bench of Justice Sushila Karki had ordered the president´s office to respond in writing why it did not accept Mahato as the prime minister.

The president´s office stated that Mahato had not been rejected and he could be the prime minister if political parties forged consensus on his candidacy. Mahato on November 29 had moved the apex court challenging the president´s office. Mahato had claimed that he could resolve the political and constitutional deadlock if he were appointed the prime minister.
