During informal discussions with the legal experts at the Prime Minister´s official residence at Baluwatar on Saturday, the advocates present concluded that the President´s call was ´unconstitutional´ and ´non-political´. [break]
Senior advocate Raghav Lal Baidhya said the Friday move by the President has confined himself. There would be no place for the President for going ahead if national consensus was not forged as per Article 38(1) of the Interim Constitution, he said.
Claiming the President´s call holds no constitutional and legal meaning, he suggested the Prime Minister run his regular activities as per the law.
The President has no right to appeal to the political parties for forming national consensus government according to the Interim Constitution where there is no Legislature-Parliament.
Similarly, senior advocate Raman Shrestha said the politics is not the business of the President and claimed his call has no meaning since it takes the country towards the directions lacking rule of law.
Advocates Ramnath Mainali, Borna Bahadur Karki, Krishna Pokhrel, Shyamji Pradhan, Deepak Bista and Balkrishna Devkota termed the President´s move unconstitutional and non-political.
There was no alternative to the continuity of the incumbent government as there is no parliament and new elections has already been announced, they said.
