After the Cabinet's decision last Monday, which removed Ghising and appointed Shakya as the new NEA MD, Ghising filed a writ in the SC, claiming that the government had removed him maliciously before the completion of his term. He has requested an interim order against the government's decision.
Meanwhile, Shakya, who filed a writ four years ago on August 16, 2021, claiming that Ghising's appointment was illegal, filed another writ stating that the current hearing should not proceed as no decision has been made on his previous writ.
Four years ago, the then government appointed Shakya as an energy expert at the Water and Energy Commission (WEC) and made Ghising the NEA MD.
Shakya had requested the annulment of the decision, claiming that his removal was illegal, and sought to reinstate him in his position. However, before a decision was reached on this, the government reappointed Shakya as the MD. The SC conducted hearings on the writs of both Ghising and Shakya together.
As the debates on Tuesday and Wednesday could not be concluded, the case was kept for further review, with a decision expected today. The legal arguments from both sides have further complicated the dispute over the leadership of the NEA.
