Senior advocate Sharma no more

KATHMANDU, Oct 28: Senior advocate Ganesh Raj Sharma, who had been bed-ridden for the last two years due to alzheimer disease, passed away on Tuesday. He was 79.

Lawyers' fraternity remembers Sharma as a renowned constitutional expert with deep and broader political knowledge and having professional integrity. Sharma held his convinction firmly and didn't compromise on it on the pretexts of professional freedom or advocating for anyone.


General Secretary of Nepal Bar Association, Sunil Pokharel, said Sharma maintained his professional integrity in an unparalleled way.

He had firm conviction on constitutionalism and he stoutly stood for prime minister's prerogative rights in a parliamentary system.

When the then Prime Minister Girija Prasad Koirala of Nepali Congress (NC) dissolved the parliament in 1994, Sharma pleaded before the Supreme Court in favor of the prime minister's right to dissolve the House.

Later, when Prime Minister Manmohan Adhikari of CPN-UML dissolved the parliament. The NC and even the lawyers who had defended Koirala's move advocated against Adhikari's right to dissolve the House.

"But Ganesh Raj Sharma was the one who consistently advocated for the prime minister's prerogative to dissolve the House in both the cases," Pokharel told Republica. "This is one of the examples of his firm conviction on certain principles, which has even top leaders from various parties respect him."

Top leaders from various political parties sought his advice when they faced crucial constitutional, political and other complications.

A close relative of late BP Koirala, one of the founders of Nepali Congress, Sharma had a broader and deep understanding of political issues. Based on the records of his conversation with BP Koirala, Sharma published the latter's autobiography entitled 'Aatmbritanta', and Jail Journal based on Koirala's experiences while in prison .
