A division bench of judges Shiva Narayan Yadav and Pushpa Koirala gave continuity to its previous order after hearing the case from both the parties on Wednesday.The court on September 1 had issued an interim order directing the ANFA not to hold its general assembly scheduled for the next day and had asked both the parties to appear in the court to present their arguments.
A dissident faction of ANFA including vice-presidents Karma Chhiring Sherpa and Bijay Narayan Manadhar and member Pankaj Nembang had filed a petition at the appellate court claiming that the establishment faction of ANFA did not inform them about the annual general assembly 60 days prior to the convention as per the statute of the football governing body.
They had also argued that the NSC Member Secretary and Minister of Youth and Sports kept mum despite their demands to stop the general assembly. Few days prior to the annual general assembly, the faction had submitted a memorandum to Minister for Youth and Sports Purusottam Paudel and NSC Member Secretary Keshav Kumar Bista demanding to stop the general assembly.
They had named Ministry for Youth and Sports, sports minister, NSC, NSC's member secretary, ANFA president and general secretary as the defendants.
ANFA which has been plagued by internal disputes since the last two years was previously grilled by the Public Accounts Committee of the Legislature-Parliament and the Commission for Investigation of Abuse of Authority. Last year's annual general assembly was also cancelled following the directives of the Public Accounts Committee.
