A single bench of Justice Govind Kumar Upadhyaya on Monday ordered the defendants to furnish reasons for not investigating Alam. The apex court has also required the defendants to explain why they should not be punished for contempt of court.
Alam was accused of murdering 23 youths who were working for him during the first Constituent Assembly election. They were allegedly injured in an explosion while making bombs and were subsequently burned alive in a brick kiln. However, the district attorney had declined to charge-sheet Alam, citing lack of evidence.Narayan Prasad Singh and Ruksana Khatun had filed a petition challenging the decision of the district attorney. Responding to their petition, the Supreme Court had annulled the decision of the district attorney and ordered further investigations into the case. Singh's son Trilok Pratan and Khatun's son Oshi Akhtar were among the 23 allegedly killed by Alam.
Arguing that the case was not investigated further and nor was a case brought to court despite the apex court order, Advocate Pushpa Raj Paudel recently filed a contempt of court case against the district attorney and the police.
