KATHMANDU, Feb 12: The Supreme Court on Thursday said that it will hear the habeas corpus petition of Rishi Dhamala before a larger bench comprising three judges after a bench comprising two judges could not take any decision whether to release or continue to detain him. Justice Avadhesh Kumar Yadav and Bharat Raj Upreti deferred the case to a larger bench after a hearing. [break]

According to Supreme Court regulations, a case is referred to three-member full bench if it involves serious constitutional and legal questions.

Earlier today the chief justice assigned the case again to Justices Yadav and Upreti who, on Wednesday, had ordered the case be heard afresh by a new bench. This order was considered unusual by legal experts.
