KATHMANDU, Feb 15: Questions have been raised in parliament over the failure to conclude the impeachment motion against former chief justice (CJ) Cholendra SJB Rana. The MPs asked questions in parliament saying that delaying justice is a great injustice.

KATHMANDU, Jan 14: Chief Justice Cholendra SJB Rana retired on Tuesday due to the age limit of 65 years, nine months after he was suspended from the post. The impeachment motion against him could neither be endorsed by parliament nor could he get a clean chit.

KATHMANDU, Dec 14: Suspended Chief Justice Cholendra Shumsher JBR retired from his post on Tuesday even as the impeachment motion filed against him in parliament remains yet to be concluded.

The Constitutional Bench has ruled that suspended Chief Justice Rana cannot resume office mainly on two grounds: First, the impeachment motion filed against Rana at the HoR has not concluded yet and that there has been a decision earlier to carry forward the motion in the new parliament. Second, the administrative chief of the federal parliament does not have rights to exercise the rights of a sovereign parliament.

The provision of impeachment against key office-bearers of the state has been made in the constitution to ensure separation of power and check and balance among the key state organs. But there is no mention of a deadline in the constitution to conclude impeachment motions once they are registered in parliament. This is a major loophole in the provision for impeachment that must be plugged if any misuse of this provision is to be avoided in the future.
