Constitutional bench to hear petition against Home Minister Lamichhane on January 6

KATHMANDU, Dec 27: The constitutional bench at the Supreme Court will hear a writ petition filed against Home Minister Rabi Lamichhane on January 6 in the constitutional bench of the Supreme Court. Advocate Raviraj Basaula and others filed the petition on December 14, demanding the cancellation of Lamichhane's position as a member of parliament (MP).

Although the first hearing on the case was conducted on December 21 by the constitutional bench, the certified copy of the order came only on Tuesday.

The constitutional bench formed under the leadership of the Acting Chief Justice Hari Krishna Karki consists of justices Ishwar Prasad Khatiwada, Anand Mohan Bhattarai, Anil Kumar Sinha and Prakash Man Singh Raut.

The petition demanded that Lamichhane not be sworn in as an MP. Lamichhane courted controversy after being embroiled in a dual citizenship case.

In the petition, it was claimed that Lamichhane had seriously violated the constitution and the law as he had registered a party and was elected as a people’s representative while he did not retain his Nepali citizenship after obtaining the American citizenship. Lamichhane, Rastriya Swatantra Party, Election Commission, Federal Parliament and District Administration Office Kathmandu are the defendants in the petition.
