KATHMANDU, May 7: The Constitutional Bench led by Chief Justice Prakash Man Singh Raut has received a petition challenging the amendment of the Judicial Council Regulations 2074 BS.
On September 18, 2023, 10 lawyers including Advocate Yagyamani Neupane on behalf of the Independent Legal Professionals Association (ILPA) filed the petition. The Constitutional Bench, consisting of Chief Justice Raut and Justices Sapna Mall Pradhan, Kumar Regmi, Hari Prasad Phuyal, and Manoj Kumar Sharma, is now reviewing the case.

The Nepal Bar Association has expressed its opposition to the amendment of Rule 11(1)(a)(b) of the Judicial Council Regulations 2074 BS. The change grants the Judicial Council the authority to appoint the Chief Registrar as a judge of the High Court, which, according to the Association, would automatically reduce the seniority of judges ranked below the Chief Justice of the High Court.
