People's representatives must resign if they want to contest again for election: SC

KATHMANDU, April 20: The Supreme Court on Tuesday ordered full implementation of the election code of conduct issued by the Election Commission of Nepal for the upcoming local level election scheduled for May 13. 

The EC’s Code of Conduct states that people's representatives in the local level seeking re-election must resign from their post before fielding their nominations for the upcoming elections. A Joint bench of Justices Tej Bahadur KC and Til Prasad Shrestha on Tuesday issued the order dismissing a writ petition filed against the provision set in the EC’s code of conduct. 

With the latest ruling of the apex court, the election code of conduct will now be fully implemented. The local level's people representatives now must resign from their post to contest in the upcoming poll. 

Helambu Rural Municipality Chairperson Nima Galyzen Sherpa on March 21 had registered writ petition in the apex court against the provision in the EC’s Code of the Conduct. 

A single bench of Justice Bom Kumar Shrestha had earlier issued an interlocutory interim order to the Commission in its rule on 'resignation for re-election'.
