Pandey had requested the EC to reconsider the party's decision to amend the statute as it was illegal. The EC, however, ruled that the decision was in line with the Constitution of Nepal, the Political Parties Act, 2073 BS and the first amendment to the Bibeksheel Sajha Party's previous statute, 2074 BS.
Seeking clarification from Pandey, Chairman Mishra had expelled the then party coordinator Pandey from the general membership.
Bibeksheel Sajha Party had sought an explanation from the then coordinator Pandey saying that despite repeated warnings he had carried out parallel activities against the party's interests contrary to his official responsibilities. He was also charged with becoming constantly absent from party meetings and making baseless allegations against the party and its leadership.
