Recommends action against APF DIG Chaudhary, SP Singh over security lapses
KATHMANDU, March 8: The National Human Rights Commission (NHRC) has recommended that the government take departmental action against Armed Police Force DIG Khadananda Chaudhary and SP Laxman Bahadur Singh.

Concluding that the two APF officials did not bother to control the riot on August 24, 2015 in Tikapur, the NHRC recommended departmental action against DIG Chaudhary and SP Singh.

Likewise, the NHRC asked the government to caution the then chief district officer of Kailali, Raj Kumar Shrestha, and administrative officer Suman Dhital concluding that the act of serious human rights violation took place due to their failure to discharge their duties.

On August 24, 2015, a mob had brutally killed eight security personnel and a toddler in Tikapur during the Tharuhat movement, just ahead of the promulgation of the constitution. The NHRC also said that it is not necessary to speak or make any recommendations about the perpetrators as cases have been already filed at the Kailali District Court against them and the cases are sub judice.

However, the NHRC has recommended to the government to make arrangements for livelihoods of the bereaved families and education of the children. The NHRC has also recommended that the government provide compensation to the Tharu families and individuals, whose houses or businesses were destroyed during the curfew hours in the aftermath of the massacre. The NHRC has also asked the government to take action against the concerned officials, who refused to register written complaints of the victims of the vandalism that took place after the massacre.

The NHRC has drawn the attention of the political parties and leaders concerned to act and speak responsibly. The commission has concluded that the provocative speeches by Sadbhavana Party Chairman Rajendra Mahato, Federal Socialist Forum Nepal Chair Upendra Yadav, Nepali Congress lawmaker Amaresh Kumar Singh and the then CPN-Maoist leader Dev Gurung laid the ground for the incidents of human rights violation in Tikapur.

Meanwhile, the NHRC asked the government to ensure that the chief district officers are present at their offices when the security situation is volatile in the districts. The commission made the recommendation after investigating the killings of three in Rangeli and Dainiya of Morang district on January 21, 2016.  Three people had died in Morang when the cadres of the United Democratic Madhesi Front (UDMF) and UML's Youth Association Nepal clashed in Rangeli and Morang.

Regarding the Morang incident, the NHRC has urged the government to caution the then secretary at the Ministry of Home Affairs, Narayan Gopal Malego, the then Morang CDO Toyam Rayamajhi and Nepal Police SP Tarani Prasad Lamsal.

Likewise, the NHRC has concluded that the security forces used excessive force in Bethari of Rupandehi during the Madhes Movement on September 15, 2015. Six individuals, including a four-year old boy, had lost their lives in the incident. The NHRC has asked the government to identify those responsible for the excessive use of force and take action against them in accordance with the law.

The NHRC has also recommended the government to provide reparation to the families of all the deceased.
