The Chief Justice is recommended that he take action against them. Council Spokesperson Man Bahadur Karki informed that the meeting decided for the action against three judges as per Section 11 (1.f.) of Judicial Council Act 2073 as they were found acting on undue influence. Similarly, section 11 (2) mentions: why can't the judges be taken action if they violated the code?. Similarly, in the same case, then judge Dr Kulratna Bhurtel, Saranga Subedi and Janak Pande would be issued a warning to act effectively by promoting the integrity and prestige of the judiciary.

The Council kept on hold the decision on two other judges- Nagendra Labh Karna and Umesh Raj Poudel involved in the case because they are now retired. The Judicial Council had formed a committee led by Supreme Court Justice Kedar Prasad Chalise with Justices Mira Khadka and Bishwombhar Prasad Shrestha as members to probe into the gold smuggling case. Similarly, the Council decided to warn Kathmandu District Court Judge Babukaji Baniya to work as per code.
