KATHMANDU, Jan 15: Hearing on the case of dissolution of the House of Representatives (HoR) is being continued on Friday as well at the Supreme Court.

The last hearing on the case had taken place on Wednesday this week. A five-member constitutional bench under Chief Justice Cholendra Shumsher Rana has yet to decide whether to send cases involving writ petitions registered against the dissolution of parliament to the extended full bench or to continue to conduct hearings itself.

Lawyers representing the petitioners and defendants have expressed differing views on the matter. Lawyers representing the petitioners have argued that a larger full bench should look into the case, instead of the constitutional bench. They are of the view that the court is the final interpreter of the constitution not the constitutional bench. The defendants are of the view that the matter should be decided by the constitutional bench as it involves issues related to the constitution.

On Wednesday, the constitutional bench decided to continue the hearing on Friday after lawyers representing the defendants couldn’t finish presenting their arguments. Lawyers representing the petitioners have already finished presenting their arguments.

As many as 13 writ petitions were registered at the apex court after the government dissolved parliament and announced midterm elections last month.
