District courts to open on holidays

KATHMANDU, Sept 28: The district courts in the country along with the Supreme Court (SC) and appellate courts have made arrangements for the hearings on writs of habeas corpus during the Dashain holidays as well.



The district courts are given such rights by amending the existing laws in this regard in a bid to provide instant legal remedy to those who have been imprisoned illegally. Earlier, only the SC and appellate courts were provided with such rights. [break]



The SC has notified the district courts to make arrangements for the same as per the Article 23 of the Judicial Administration Act -2048 BS, if the courts were likely to close for over a week, said Assistant Spokesperson of the SC, Hemant Rawal.



He informed RSS that the full court of the SC and appellate courts would determine the names of judges for hearing which also applies in the district courts, if two or more judges were serving in the district courts. But if a single judge is assigned in the district court, s/he will continue the hearing on habeas corpus as well.



However, the courts will remain closed on Ghatasthapana and Bijaya Dashami of Dashain and on Saturdays.
