Province 2 minister files writ petition against ‘interference’ made by federal govt

KATHMANDU, Dec 3: As a fresh instance of confrontation between the federal and provincial government, Province 2 Government on Thursday knocked the doors of the apex court, citing interference by the federal government on the matters under its jurisdiction.

Province 2 Minister for Physical Infrastructure, Jitendra Sonal filed a case against the federal government at the Supreme Court (SC). Province 2 Government has claimed that the federal government has interfered with the jurisdiction of the provincial government going against the Schedule 6 of the Constitution of Nepal.

In the writ petition, the province government has claimed that a circular made by the Underground Water Resources Development Committee (UWRDC) on November 6 and a tender bid invited by the Prosperous Terai-Madhesh Irrigation Special Program, on November 9 had breached the jurisdiction of the provincial government.

The writ petition has demanded withdrawing the circular made by the UWRDC, asking the federal government to return the building, vehicles, and other physical infrastructures to the provincial government.

The writ also demanded an order from the apex court to declare the bid invalid as the project is being operated by the provincial government. The court has scheduled the cause list of the writ for December 11.
